Terms of Service
Last updated: October 16, 2026
These Terms of Service govern your access to and use of www.paulfellbaum.com, including all purchases made through the website. The website is owned and operated by Paul Fellbaum, doing business as Paul Fellbaum (“we,” “us,” or “our”).
By accessing our website, creating an account, submitting an order, or purchasing a product, you agree to these Terms of Service, our Privacy Policy, Return and Refund Policy, and any other policies displayed on the website.
If you do not agree to these terms, do not use the website or submit an order.
1. Eligibility
You must be at least 18 years old or the age of legal majority where you live to place an order. If you are under the applicable age of majority, you may use the website only with the involvement and permission of a parent or legal guardian.
By placing an order, you represent that:
The information you provide is accurate and complete
You are authorized to use the selected payment method
Your purchase complies with applicable laws
You are purchasing for lawful purposes
We may refuse or cancel an order if we reasonably believe these requirements have not been met.
2. Website information
We make reasonable efforts to keep product descriptions, photographs, availability, pricing, and other website information accurate. However, minor errors, omissions, or differences may occur.
Product colors and appearance may vary depending on photography, lighting, materials, manufacturing variations, and the customer’s screen settings. Measurements and dimensions are approximate unless expressly stated otherwise.
We reserve the right to correct errors and update website information without prior notice.
3. Products and availability
Products and services are subject to availability. Placing an item in a shopping cart does not reserve it.
We may:
Limit the quantity of products available to any person, household, address, geographic region, or order
Discontinue or modify products
Correct inventory errors
Refuse or cancel orders
Substitute packaging that does not materially alter the product
Establish purchase limits
If we cannot fulfill an order, we will cancel the affected portion and refund the corresponding amount to the original payment method.
4. Orders
Submitting an order is an offer to purchase the products in that order. An automated order confirmation means we have received the order; it does not necessarily mean the order has been accepted.
We may review, accept, refuse, or cancel an order for reasons including:
Product unavailability
Pricing or description errors
Suspected fraud or unauthorized payment
Incorrect billing, shipping, or contact information
Violation of these terms
Restrictions imposed by a carrier, payment processor, or applicable law
If we cancel an order after payment has been collected, we will issue an appropriate refund to the original payment method.
5. Pricing
Prices are displayed in U.S. dollars unless otherwise stated.
Prices may change without notice. The price charged will generally be the price displayed when the order is submitted, subject to the correction of obvious errors.
Displayed product prices may not include:
Shipping and handling
Sales, use, or other applicable taxes
Duties, tariffs, customs fees, or import charges
Optional delivery services
Other charges disclosed during checkout
The customer is responsible for reviewing the complete order total before submitting payment.
6. Payment
We accept the payment methods displayed during checkout. Payments are processed through Squarespace Payments or another third-party payment processor.
By submitting payment information, you:
Represent that you are authorized to use the payment method
Authorize us and our payment processor to charge the order total
Authorize the processing of refunds, adjustments, and other permitted transactions
Agree to provide current and accurate payment information
We do not directly store complete payment-card information. Payment processing is subject to the terms and privacy practices of the applicable payment provider.
An order may be delayed or canceled if payment cannot be authorized or verified.
7. Taxes
Applicable sales and similar taxes will be calculated and displayed during checkout when required.
Customers are responsible for any taxes, duties, customs charges, or government fees not collected during checkout. Tax-exempt customers must contact us before ordering and provide acceptable documentation.
8. Shipping and delivery
Shipping options, charges, and any estimated delivery information are displayed during checkout or on the applicable product page.
Unless otherwise stated, delivery estimates are not guaranteed. Delays may occur because of weather, carrier disruptions, holidays, supply issues, incorrect addresses, customs processing, or circumstances beyond our reasonable control.
Customers are responsible for providing a complete and accurate delivery address. We are not responsible for delays or losses caused by incorrect or incomplete customer-provided information.
If an order is returned because it was refused, unclaimed, or undeliverable, we may deduct the original shipping charge and carrier return fees from any available refund. Additional payment may be required to reship an order.
9. Risk of loss and delivery problems
Responsibility for loss or damage will be determined according to applicable law, the selected shipping method, and the carrier’s findings.
If an order arrives damaged, defective, incomplete, or incorrect, contact us promptly at paulfellbaumpaintings@gmail.com. Keep the merchandise, packaging, shipping label, photographs, and related documentation until we provide instructions.
If tracking shows an order as delivered but it cannot be located, the customer should first check with household members, neighbors, the carrier, and the delivery location. We will provide reasonable assistance with carrier claims when appropriate.
10. Returns, refunds, and exchanges
Returns, refunds, exchanges, cancellations, damaged merchandise, and nonreturnable items are governed by our Return and Refund Policy, which is incorporated into these Terms of Service.
Please review that policy before purchasing. The policy is available at:
See the Return and Refund Policy included with these Terms of Service.
Unless required otherwise by law:
Returns require prior authorization
Customers are responsible for return shipping on discretionary returns
Original shipping charges are not refundable on discretionary returns
Customized, personalized, made-to-order, clearance, and final-sale items may be nonreturnable
Refunds are issued to the original payment method
Financial institutions may require additional time to post a refund
Nothing in these terms limits consumer rights that cannot legally be waived.
11. Customized and personalized products
The customer is responsible for reviewing all names, wording, dates, sizes, colors, artwork, files, and other customization information before submitting an order.
We may reproduce customization details exactly as provided. Unless the error was caused by us, we are not responsible for mistakes contained in customer-submitted information or approved proofs.
Customized, personalized, or made-to-order products may not be canceled after production begins and may not be returned unless they arrive damaged, defective, or materially different from the approved order.
12. Promotions and discount codes
Promotions, coupons, and discount codes:
Are subject to their stated terms and expiration dates
Have no cash value
May be limited to one use per customer or order
May exclude certain products or categories
May not be combined unless expressly stated
May be canceled if used fraudulently or contrary to their terms
Discounts cannot normally be applied retroactively to completed orders.
We may modify or discontinue a promotion as permitted by law.
13. Gift cards (if offered)
Gift cards are subject to any additional terms displayed when they are purchased or redeemed.

18. Third-party services and links
The website may use or link to third-party services, including Squarespace, payment processors, carriers, social-media platforms, analytics services, and other websites.
We do not control third-party services and are not responsible for their independent content, availability, security, policies, or conduct. Your use of a third-party service may be governed by that provider’s terms and privacy policy.
A link does not imply endorsement.
19. Privacy
Our collection, use, and protection of personal information are described in our Privacy Policy:
See the Privacy Policy included with these Terms of Service.
By using the website, you acknowledge that website operations may require information to be shared with service providers such as Squarespace, payment processors, shipping carriers, analytics providers, and other vendors necessary to process orders and operate the business.
20. Disclaimer of warranties
To the fullest extent permitted by law, the website and its content are provided on an “as is” and “as available” basis.
We do not guarantee that:
The website will always be available, uninterrupted, secure, or error-free

21. Limitation of liability
To the fullest extent permitted by law, Paul Fellbaum and its owners, employees, representatives, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the website, an order, a product, delivery, or these terms.
To the fullest extent permitted by law, our total liability arising from a product or order will not exceed the amount the customer paid for the product or order giving rise to the claim.
These limitations do not apply where prohibited by law or to liability that cannot legally be limited.
22. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless Paul Fellbaum and its owners, employees, representatives, contractors, and service providers from third-party claims, damages, liabilities, losses, and reasonable expenses arising from:
Your unlawful use of the website
Your violation of these terms
Your infringement of another person’s rights

Fraudulent, abusive, or unauthorized conduct associated with your account
This section does not require you to indemnify a party for conduct for which indemnification cannot legally be required.

We are not responsible for a delay or failure caused by events beyond our reasonable control, including severe weather, natural disasters, fire, labor disputes, transportation interruptions, carrier failures, utility or internet outages, cyberattacks, government actions, epidemics, supply shortages, or similar events.
We will make reasonable efforts to communicate material delays and determine an appropriate resolution.
24. Governing law
These Terms of Service are governed by the laws of the State of Wisconsin, without regard to conflict-of-law rules, except where another jurisdiction’s consumer-protection laws must apply.
Any legal proceeding arising from these terms or a purchase will be brought in a court with proper jurisdiction located in Chippewa County, Wisconsin, unless applicable law permits or requires another location.
Before filing a legal claim, the parties are encouraged to attempt to resolve the issue by contacting one another in good faith.
25. Severability
If any provision of these terms is held invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted or removed, and the remaining provisions will continue in effect.
